When asked to comment, La Rue said, “Having domestic violence charges filed against you can come as a big blow. When going up against such serious allegations, hire a seasoned criminal lawyer who can help formulate the best defense strategy for your case.”

While all cases require specific tailored approaches to the circumstances alleged, it is common to defend one’s client first, in a domestic violence case according to La Rue, by reviewing the prosecution’s case for weaknesses in their evidence and the gathering of that evidence.

“One way to go about this is to prove the prosecutor – who carries the burden of proving the defendant’s guilt - lacks sufficient evidence to meet his burden of proof beyond a reasonable doubt. Frequently, the evidence presented isn’t enough, or is not sufficiently reliable for a domestic violence conviction to be proven beyond a reasonable doubt.”

Exposing and exploiting problems with the prosecution's case can also help in revealing that a false accusation where no physical altercation took place, is easily brought, but is unlikely to be proven under the law if challenged aggressively by skilled defense counsel.

“Unfortunately, with the increase in domestic violence rates around the country comes an increase in false accusations. False allegations are often made when one partner stands to gain something in a divorce, such as winning a child custody suit or getting a larger settlement,” La Rue said.

He added that, “If this is the case, then you and your attorney should build a defense by finding inconsistencies in statements to police, legal arguments, and police records, as well as by establishing a motive for a false accusation.”

Showing that the prosecution has charged the wrong suspect is another common defense strategy, according to La Rue.

''In going this route, your attorney will attempt to prove that the client did not cause the initial alleged physical confrontation, depending on where the evidence leads.“

La Rue added, that the accused could also use technology, such as a phone log analysis to prove a client’s innocence.

When asked to elaborate he said, “Another compelling way to prove your alibi is by providing photos of videos that have been time-stamped showing you far away from where the alleged incident happened.” “Also, given the data produced by our electronic devices we carry every day such as our phone, laptop, and/or tablet, a great deal of evidence can be obtained to prove the whereabouts of those items at any given time, and thus, their owner.”

All of this is why La Rue warned that pleading guilty or “no contest” at the outset will not only hurt your case, it may be impossible to resurrect it.

“Even with the best criminal attorney and the perfect defense strategy, your chance of reaching a positive outcome decreases significantly once you plead guilty to a domestic violence charge," he said.
