ATLANTA - Nov. 16, 2018 - PRLog -- The parents of Troy Ryan Dailey, Troy Richard Dailey and Brandee Dailey have filed a lawsuit against a methadone clinic based in Dekalb County Georgia, Alliance Recovery Center, Inc., as well as against the two drivers involved in the fatal collision. Mr. Dailey was age 25 at the time of the collision. They have also brought suit against the parent of one of the drivers who owned the vehicle involved. The lawsuit was filed in Dekalb State Court with docket number 18A72045.
The collision occurred in Covington, Georgia on December 3, 2016. Mr. Dailey was riding as a passenger with his wife Taylor Dailey. She made a turn and her car was struck at high speed by Timothy Wayne Anderson, driving a pickup truck.
Taylor Dailey has subsequently remarried and her name is now Taylor Chriswell. Ms. Chiswell currently faces criminal charges for DUI as she was found to have methadone and fentanyl in her system following the collision. A witness statement reported that Mr. Anderson was driving his vehicle at a very high rate of speed prior to the fatal collision.
Ms. Chriswell was undergoing methadone treatment at Alliance Recovery Center, Inc., which is believed to have been the source of the methadone in her system. She also had fentanyl in her system, an opioid drug. She is currently facing criminal prosecution in Newton County, Georgia. Plaintiffs contend that Ms. Chriswell should not have been provided methadone while also under the influence of fentanyl and with the knowledge that she would be operating a motor vehicle under the influence of methadone. Methadone is also an opioid drug, often used to treat people addicted to narcotics.
The car driven by Ms. Chriswell was owned by her father, Thomas Blackwell. The lawsuit alleges that Mr. Blackwell negligently entrusted his vehicle to Ms. Chriswell. She was having substance abuse problems prior to the accident and was being treated with the opioid drug methadone. The lawsuit alleges that providing her with a car constitutes negligent entrustment, for which the car owner can be held responsible.
Based on public records, Mr. Anderson has previously had his driver's license suspended for motor vehicle driving violations. In 1987, Newton County convicted him of the felony offense of being a habitual violator, which means that he had at least three traffic offense convictions within a 5 year period.
